Infrastructure Agreements
Large developments may require significant infrastructure improvements, including new infrastructure needed to serve the development or the acceleration of planned City infrastructure projects. An Infrastructure Agreement establishes the respective responsibilities of the developer and the City for infrastructure associated with a project, including what improvements are required, who will construct them, how costs will be allocated, and when improvements must be completed.

- Roads, water, wastewater, or other infrastructure improvements
- Public safety infrastructure or facilities
- Responsibility for infrastructure costs and construction
- Community or other capital improvement contributions that are separate from infrastructure required to serve the development
- Other project-specific commitments
Why is this important?
An Infrastructure Agreement clearly identifies the responsibilities of the developer and the City and documents how infrastructure associated with the development will be constructed, funded, and completed. It also establishes enforceable commitments for the responsibilities identified in the agreement.
For the Rowan development, the proposed Infrastructure Agreement establishes the developer’s financial responsibilities for water infrastructure improvements and includes a separate, voluntary $13 million Cooperative Endeavor Contribution for community capital improvements. The proposed contribution includes $10 million toward an Aquifer Storage and Recovery Project and $3 million toward a Community Center.
The Cooperative Endeavor Contribution is separate from the infrastructure payments required under the agreement and is not required to provide water and wastewater service to the development.
City Council will consider the proposed Infrastructure Agreement at its September 17 meeting.
